Statutory Validity Conditions

For the note to be accepted by the execution judge, it must include mandatory details:

  • Document Wording: The exact phrase "Promissory Note" must be written clearly in the document's text.
  • Promise to Pay: An absolute and unconditional promise to pay a precise sum of money.
  • Maturity Details: A clear maturity date and the agreed-upon place of payment.
  • Parties Involved: The clear name of the beneficiary and the explicit signature of the issuer (debtor).

Digitization and E-Execution

To eliminate forgery of paper notes, the Ministry of Justice introduced innovative tech solutions:

  • Nafith Platform: Notes are created and authenticated electronically, linked to the National Single Sign-On.
  • Najiz Execution: Upon debtor default, an electronic execution request is directly filed via Najiz.

Deterrent Measures Against Defaulters

If the debtor fails to pay within 5 days of notification, the judge applies strict sanctions:

  • Service Suspension: All government services for the defaulting debtor are immediately suspended.
  • Financial Freezing: Forced freezing is applied to bank and investment accounts.
The right to execute a promissory note expires after three years from the maturity date, so prompt action is required.
